Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Pista Works LLC ("Company," "we," "us," or "our") regarding your use of Reflectial, including our website, mobile application, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Immediately notify us of any unauthorized use of your account
• Be responsible for all activities that occur under your account

You must be at least 13 years old to create an account and use the Service.

Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Violate or infringe upon the rights of others
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to transmit viruses, malware, or other harmful code
• Harass, abuse, or harm another person through the Service
• Impersonate any person or entity
• Collect or harvest information about other users
• Use automated systems to access the Service without permission

Your Content

The Service allows you to create, post, and store content, including journal entries, mood data, and other personal information ("Your Content"). You retain all ownership rights to Your Content. By posting Your Content to the Service, you grant us a limited license to:

• Store, process, and display Your Content as necessary to provide the Service
• Use Your Content to generate AI-powered insights for your personal use
• Back up Your Content for data protection purposes

You represent and warrant that: (1) you own or have the necessary rights to Your Content; (2) Your Content does not violate any third-party rights; and (3) Your Content complies with these Terms and applicable laws.

Intellectual Property Rights

The Service and its original content (excluding Your Content), features, and functionality are and will remain the exclusive property of Pista Works LLC and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written permission.

AI-Powered Features

Reflectial uses artificial intelligence to analyze your journal entries and provide personalized insights. You acknowledge that:

• AI-generated insights are for informational purposes only
• The Service is not a substitute for professional medical, psychological, or therapeutic advice
• AI analysis may not always be accurate or complete
• You should consult qualified professionals for health-related concerns

Subscription and Payments

Some features of the Service may require a paid subscription. By purchasing a subscription, you agree to:

• Pay all fees associated with your subscription
• Provide current, complete, and accurate billing information
• Update your payment information as needed
• Automatic renewal of your subscription unless cancelled

Subscription fees are non-refundable except as required by law or as explicitly stated in our refund policy.

Cancellation and Termination

You may cancel your subscription at any time through your account settings. Upon cancellation:

• You will retain access until the end of your current billing period
• Your subscription will not automatically renew
• You may continue to access your data during the paid period

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine to be harmful to other users, us, or third parties.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PISTA WORKS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM: (1) YOUR USE OR INABILITY TO USE THE SERVICE; (2) ANY UNAUTHORIZED ACCESS TO OR USE OF YOUR DATA; (3) ANY INTERRUPTION OR CESSATION OF THE SERVICE; OR (4) ANY BUGS, VIRUSES, OR OTHER HARMFUL CODE TRANSMITTED THROUGH THE SERVICE.

Indemnification

You agree to indemnify, defend, and hold harmless Pista Works LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with: (1) your access to or use of the Service; (2) Your Content; (3) your violation of these Terms; or (4) your violation of any rights of another party.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in Albuquerque, New Mexico.

Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
